Supplier and agreement
Gift Aid Desk is supplied by Ben Smith trading as MGH Consultants, a sole trader, at 9 Dalhousie Street, Carnoustie, DD7 6EJ. Contact: Ben.smith@mghconsultants.com. By creating an account or continuing to use the service, you agree to these terms with MGH Consultants. You must have authority to act for your organisation and keep your details and sign-in credentials accurate and secure.
Service and responsibilities
The service captures Gift Aid declarations linked to admissions sales, assists manual review and prepares claim schedules. Your organisation remains responsible for qualifying donations, valid declarations, donor communications and submitting accurate claims. Internal flags, AI answers, receipts and downloaded schedules do not establish HMRC approval. Availability and error-free operation are not guaranteed; check your records and maintain appropriate exports.
Subscriptions and payments
Prices are GBP £9.99 per calendar month or £95.90 annually. Eligible new accounts receive one month of trial access with a payment method required. Subscriptions renew automatically unless cancelled; trial and paid subscriptions include all features. Cancellation retains access through the current period. Existing records remain available to view and export afterward, and owners can disconnect or delete retention-eligible records. Returning customers restart without another trial. MGH Consultants does not charge VAT; Paddle may apply taxes at checkout.
Monthly/annual plan-change requests do not immediately change your price. A request is not a confirmed future switch; the existing plan continues until a change is expressly confirmed. Automatic deferred plan switching is not currently available.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. MGH Consultants provides application support. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle’s Buyer Terms and its refund policy. Nothing here removes mandatory statutory rights.
Acceptable use and AI
Do not use the service unlawfully, for fraud or spam, infringe intellectual-property rights, upload malware, probe security, scrape private records or circumvent access controls. Do not submit illegal content, hateful content, deceptive deepfakes, malware instructions or attempts to override AI safeguards. Do not use prompts or outputs to mislead, defraud, harass or violate another person’s rights. You must have rights to all inputs and are responsible for prompts and your use of outputs. Before relying on or sharing an output, review its accuracy, appropriateness and intellectual-property rights. Do not use or distribute outputs you know or reasonably suspect infringe another person’s rights. Verify AI answers: they may be inaccurate and are not regulated legal or tax advice or a determination of Gift Aid eligibility. AI cannot automatically approve, submit or alter a claim.
We reserve the right to refuse/filter outputs, remove unlawful content, restrict features or suspend accounts for serious or repeated misuse or infringement. This does not promise that every input or output is checked or that unsafe outputs will always be detected. Rights holders can report concerns to the supplier email above.
Intellectual property and customer records
MGH Consultants retains ownership of the service software, documentation and branding. We grant a limited non-exclusive, non-transferable licence for your organisation’s permitted use. Do not resell, redistribute, reverse-engineer or bypass technical limits except where the law permits. You retain rights in your inputs and records; you grant us permission to host and process them only to supply, secure and support the service. AI outputs are subject to applicable law and third-party rights; exclusive ownership or non-infringement is not guaranteed.
Suspension, exit and retention
We may suspend or terminate ordinary service access for material breach, non-payment, security or fraud risks, or repeated/serious policy violations. Required Gift Aid evidence remains subject to retention controls. Declarations are retained until six years after the most recent claimed donation; unknown history or unexpired deadlines block deletion. Disconnecting removes locally held store credentials and rotates register links, but does not itself revoke authorisation in Lightspeed. There is no automatic purge or promise that exported copies or provider backups disappear immediately.
Legal and processing arrangements
Liability remains subject to applicable law; nothing excludes liability that cannot lawfully be excluded, including fraud or death/personal injury caused by negligence. Charity-controller processing instructions and any required processor agreement must be agreed separately. The supplier must complete the organisation-specific processing and provider/transfer documentation before relying on this service for production donor records.
